چکیده
 
عدالت کیفری در قلمرو رفتارهای جنسی، تحولات شگرفی را در یک بازه زمانی خاص به خود می بیند. این تحولات متاثر از ریشه و آموزه های حمایت کننده ای است که فرهنگ انضباط جنسی خوانده می شود. جریان های فکری، سیاسی و مذهبی به دلایلی که ریشه های معرفت شناسانه دارد وضعیت ناپایدار قرون وسطا را بر هم می زند و موج لوتری اروپای بری و بحری را فرا میگیرد. این موج تاثیرات شگرفی در زمینه شداد و غلاظ بخشی به واکنش کیفری در پی دارد که دلایل شکل گیری و آثار آن مورد بررسی قرار میگیرد. گذار از قرون وسطی در این برهه از تاریخ شکل می گیرد و این گذار در حوزه ی عدالت کیفری در قلمرو رفتارهای جنسی با تحولات چشم گیری همراه می گردد. کیفرشناسی و کارکردگرایی کیفری این دوران که متمرکز بر حیطه ی اختصاصی این جستار (رفتارهای جنسی) می باشد، تحلیل دقیق تری از وضعیت عصر فرآهم می آورد و تاثیرپذیری ها و تاثیر گذاری های این دوران از تاریخ را در  قلمرو عدالت کیفری تبیین می سازد و نشان می دهد چگونه افت و خیزهای جریانات معرفت شناسانه ی اروپا اولاً در گذار از سیاست کیفری قرون وسطی و ثانیاً در نیل به عصر روشنگری موثر واقع گردیده است.

چکیده English

Criminal justice faced tremendous developments in the field of sexual behaviors during the fifteenth to seventeenth A.D in Europe. These developments had been profoundly influenced by the supportive culture and religious doctrines called sexual discipline. Intellectual, political and religious proceedings blew to the unstable situation of Medieval and Lutheran wave surrounded the Europe including continental and United Kingdom. Transitional period took a place at this time within the history of law in the field of criminal justice and sexual behaviors; this transition went along with outstanding developments. Focusing on penology, functionalistic and paternalistic approach of this age which is specifically based on sexual behaviors in this research achieves a better understanding of the atmosphere of this period and explains the effectiveness and affectability of this time within the field of criminal justice
