This undeniable fact is worth considering from the numerous aspects. By conferring exceedingly freedom to act, the governments paved the way for outbreaking any kind of conduct, even violent conduct for their citizens. After losing the authority to control the security of society by exceedingly elimination and exclusion of liberties, they prepared the ground for violating citizens’ rights and by this means the governments sought to prevent happened excess and indulgence. Subsequently, by making pretext for the security, they embarked on politicization of criminality, particularly terrorist offences and apparently in this regard they have been successful. They not only confirmed their attitude, but also made the public align with their policies in criminal scope. That the governments ignored necessary expertness for proceeding and dealing with terrorist offences by manipulating the well settled principle of separation of powers, and undue intervention in other powers spectrum is the most important matter. In foreign policy also, they created considerable developments. This essay tackles on examining these matters.</em> بخشِ قابل‌توجهی از منشأ و خاستگاهِ دادرسیِ کیفری افتراقی در جرایمِ تروریستی را باید در سپهرِ سیاست و نگرشِ سیاستمداران به پدیده­ی بزهکاری و به­ویژه تروریسم جستجو نمود. این واقعیّتِ غیرقابل‌انکار، از چند حیث قابل‌توجه است؛ دولت‌ها ابتدا با اعطایِ آزادیِ عملِ بیش‌ازحد، زمینه­ی بروزِ هر نوع رفتار حتی رفتارِ خشونت­آمیز را به شهروندانِ خود اعطا کردند و پس‌ازاینکه توان کنترلِ امنیت جامعه را از دست دادند، از طریقِ حذف و حصرِ بیش‌ازاندازه‌ی آزادی­ها، زمینه­ی نقضِ حقوقِ آن‌ها را فراهم آوردند و درصدد بودند از این طریق، جلوی افراط و زیاده­روی­های پیش­آمده را بگیرند. در ادامه دولت‌ها با دستاویزِ امنیت، به سیاسی­سازیِ بزهکاری و به­ویژه جرایمِ تروریستی مبادرت نموده و ظاهراً در این کار نیز، موفّق بوده­اند. آن‌ها نه­تنها بر نگرش و طرزِ تفکّرِ خود صحّه می­گذاشتند، بلکه عمومِ مردم را نیز باسیاست‌های خود در حوزه­ی کیفری، همسو می‌نمودند. از همه مهم‌تر اینکه آن‌ها با برهم­ زدنِ اصلِ پذیرفته‌شده‌ی تفکیکِ قوا و مداخله­ی نابه­جا در حوزه­های سایرِ قوا، تخصّصِ لازم برای رسیدگی و برخورد با جرایمِ تروریستی را نادیده انگاشته و در حوزه­ی سیاست خارجی نیز، تغییراتِ قابل‌توجهی ایجاد نمودند. این تحقیق به بررسی این موارد می­پردازد. https://jclr.atu.ac.ir/article_2396_dcf6070a4ab7f3afbfd2809173e0824b.pdf
