Journal Article 2025 04 24 The criminal liability of a partner for committing the two crimes of aggressive appropriation and destruction of common property is an issue that has long been controversial in the Iranian legal system. The following study, focusing on the judicial practice of Tehran province over the past decade, faces the following questions: “How does the judicial practice of this province comply with the legislator’s opinion regarding the crime of aggressive appropriation of common property after the enactment of the Islamic Penal Code of 1392?” Also, “To what extent is the judicial practice of the targeted province regarding the crime of destruction of common property in line with the unanimous decision of the Court of Procedure No. 10 dated 21/07/1355?” The findings indicate that the situation of the judicial practice of Tehran province over the past decade regarding the crime of aggressive appropriation of common property by one of the partners is not desirable. Furthermore, considering the aforementioned unanimous ruling, the judicial procedure of this province regarding the crime of destruction of common property also lacks the necessary alignment with this ruling in some cases. مسئولیت کیفری شریک در ارتکاب دو جرم تصرف عدوانی و تخریب نسبت به مال مشاع، از دیرباز یکی از مسائل مناقشه‌برانگیز در نظام حقوقی ایران به‌شمار می‌رود. مطالعۀ پیش‌رو با تمرکز بر رویۀ قضایی یک دهۀ اخیر استان تهران، با این پرسش‌ها روبرو است که «انطباق رویۀ قضایی این استان در قبال تحقق جرم تصرف عدوانی نسبت به مال مشاع، پس از تصویب قانون مجازات اسلامی سال 1392، با نظر مقنن چگونه است؟» و همچنین «رویۀ قضایی استان مورد هدف درخصوص جرم تخریب مال مشترک تا چه میزان با رأی وحدت رویۀ شمارۀ 10 به تاریخ 21/07/1355، همسویی دارد؟». در راستای پاسخ به سؤالات پیش‌گفته، کوشش شده است عملکرد رویۀ قضایی استان مورد نظر در قبال جرائم یادشده به شیوۀ تحلیلی-توصیفی و از طریق بررسی آرای گردآوری‌شده، تا حدی روشن شود. یافته‌های به‌دست‌آمده در پژوهش حاضر، نشانگر این حقیقت است که وضعیت رویۀ قضایی استان تهران طی یک دهۀ اخیر درخصوص ارتکاب جرم تصرف عدوانی از سوی یکی از شرکا در مال مشاع، مطلوب ارزیابی نمی‌شود. افزون‌بر این ، باتوجه به رأی وحدت رویۀ‌ صادر‌شده، رویۀ قضایی این استان در قبال جرم تخریب مال مشترک نیز در برخی از موارد فاقد همسویی لازم با این رأی است. https://jclr.atu.ac.ir/article_20546_a201a8442dd39b947a725762a346b949.pdf
